Why or why not?

Part 1:
<
<
You may have heard about the McDonald’s hot coffee case. This is a pretty misunderstood case that involves tort laws – both negligence and strict liability. Complete the following analyses after watching this video of what really happened in this case: https://www.youtube.com/watch?v=pCkL9UlmCOE
<
<
Analyze negligence:
<
<
What was McDonald’s duty to its customer?
<
Did McDonald’s breach this duty?
<
Did McDonald’s conduct cause the woman’s injuries?
<
Did the woman suffer actual damages?
<
What, if any, defenses does either party have?
<
Analyze strict liability:
<
<
Does strict liability apply here? Why or why not?
<
Would this be a manufacturing or design defect?
<
Does either party have any defenses?
<
If you were Ms. Liebeck’s attorney, which theory of tort liability (negligence or strict liability) would you advise her is her strongest argument? Why?

<
Part 2:
<
<
In January 2001 a New York man attended a family birthday party at a Benihana restaurant, where chefs, while cooking at the table, routinely throw pieces of food for diners to catch with their mouths. The New York man wrenched his neck while ducking a piece of flying shrimp, requiring treatment by several doctors. By that summer, doctors determined surgery was necessary to treat numbness in his arm. Five months after surgery, he checked into the hospital with a high fever and died. The family sued Benihana for $10 million in damages, claiming that the fever was the result of surgery, which in turn was the result of the chef’s actions in throwing food at diners.

<
<
Analyze negligence in this case by answering the following questions:
<
<
What duties do both parties (Benihana and the customer) have in this situation?
<
Explain whether the parties breached their duties and why or why not.
<
Explain causation (actual cause and proximate cause) in this case.
<
What damages would be claimed in this type of case?
<
Discuss any defenses that might be available to both parties.
<
Do you believe that Benihana should be liable for the man’s death? Why or why not?

What are the strengths and limitations of each, what types of information can only be collected by human espionage versus technical espionage, what are the organizational differences in how we conduct human versus technical espionage, what are the costs invested in human versus technical espionage, what are the problems in managing the information we collect by human espionage versus technical espionage, etc.

It is a requirement that you use at least 6 scholarly sources in researching and writing this assignment. Here are a few questions to prompt your thinking. But you should develop your own measures and present them in your paper.

You must use facts and examples to bear out your evaluation. Include real-life cases (with specific dates, places, names, outcomes, effects, etc.). You must conduct research beyond what is in the readings in the class. You are expected to have at least 6 outside reliable sources (journals, government reports and studies, verified public information, etc.).

Research this topic further and support your arguments with the results of that research.

The Texas Legislature passed a law requiring public colleges and universities in Texas to allow for licensed concealed carry of handguns on campus. The implementation of the law is occurring in two phases. Campus carry began for public universities on August 1st of 2016 and it began on community college campuses on August 1st of 2017,
<
This measure was popular when it was debated and it was supported by a majority of Texans. However, the measure was opposed by a majority of college students and faculty. That opposition continues as colleges implement campus carry and it seems prudent to revisit this issue.
<
Should campus carry be allowed in Texas? Research this topic further and support your arguments with the results of that research. I have included an article below to provide a highlight of some of the issues present in this debate, but this is not an exhaustive accounting. (While interesting, I would prefer that you NOT debate whether or not class or office hours should be held in bars to bypass campus carry)

In the course, you learned to:
<
<
Determine the impact of proposed strategic decisions across departments
<
Assess current performance of an organization through analysis of financial statements
<
Make ethically informed decisions based on awareness of legal and organizational parameters
<
Now, it’s time to reflect on what you’ve learned.
<

Prompt
<
To complete this assignment:
<
<
Identify three key topics from the course that you want to explore further. For example:

How do various functional areas or departments individually and collectively contribute to the CSR outlook of a company?
<
How can analyzing financial statements of a company help reveal its commitment toward CSR?
<
How can a company become a frontrunner in making ethical choices while staying within legal restrictions?
<
Apply the chosen three topics to re-evaluate the company you chose in Module One (you can consult the list of companies).
<
Your re-evaluation should address one of the following considerations:
<
Related to the topic, what was your first impression of the company you chose? What is your current impression of the company? How has it changed? Explain your reasoning.
<
What drives the direction for the company in its sustainability efforts?
<
What are the key features of the CSR efforts of the company?
<
Do you believe the company has a sustainable approach to the triple bottom line?
<
What are the critical financial, social responsibility, or ethical challenges facing the company in today’s global environment?
<
Based on your evaluation, justify whether the company you chose in Module One deserves praise for its commitment to CSR.
